Every commercial enterprise will at one time or another, buy, sell or manage property. However, this can lead to disputes, particularly felt by those who operate exclusively in the property sector especially housing associations and commercial developers.
Prettys has a property dispute resolution team which is able to act when disputes of this nature arise. The team works closely with Prettys substantial commercial dispute resolution and commercial property teams.
The work we do is varied. We advise parties in relation to large and small property portfolios and can assist in all disputes of a property nature including issues relating to option agreements, development agreements, pre-emption rights, covenants, easements, rights of way and service charge claims. Our client base is also broad. We currently act for local and national developers, banks, insolvency practitioners in their capacity as receivers, liquidators or administrators, builders and retail landlords and tenants.
The team endeavours to retain a commercial focus and is aware that clients do not want to litigate issues unnecessarily. As a result, we have experience in attempting to resolve disputes without involving the court, in particular via mediation. However, it is accepted that in some circumstances, legal proceedings, adjudication or arbitration may be the only method of resolving some disputes. The team has experience in each forum.
