Corporate Recovery and Insolvency
We have one of the leading corporate recovery and insolvency practices in East Anglia, led by Alistair Bacon, who has many years experience in insolvency work.
The team provides advice and assistance to insolvency practitioners, businesses and individuals (whether as debtors or creditors) on a full range of corporate and individual insolvency matters, as well as on legal aspects of business turnaround.
Our work includes advice on:
- the suitability and mechanics of formal insolvency procedures including liquidation, administration and voluntary arrangements
- informal arrangements with creditors and turnarounds
- pre-pack transactions and other insolvency based business sales
- retention of title claims
- antecedent transactions including preference, transactions at undervalue and misfeasance wrongful and fraudulent trading
- insolvency office holders’ appointments, rights and powers
- creditors’ claims
- staying winding up orders
- the defence of proceedings brought against directors under the Company Directors Disqualification Act 1986 and applications for permission to continue to act as a director of a limited company notwithstanding disqualification or bankruptcy.
We aim to use our technical expertise and experience to provide the quick practical advice which situations including insolvency or financial difficulties demand. We believe that a measure of the success of this approach and our ability to deliver service built on it is reflected in the firm’s growing reputation in the insolvency arena and the growing number of insolvency and turnaround specialists for whom we act.
What they say about us
Quoted from Chambers 2008
“The team as a whole is very efficient” and is looking to expand. In the past year, it has worked on several notable matters. It successfully advised a director facing disqualification proceedings, and the matter was discontinued before trial. It also obtained a stay of winding-up proceedings for a company and its director. Leading the team on both of those matters was department head Ian Waine. “A real expert in the area,” he also acted on a complex ancient bankruptcy.
