Board Room Table

Who is present?

This is where you carry out discussions directly with the other party on your own.

What are the rules?

There are no rules as such. Both parties may have solicitors in the background to advise them and help identify the issues to be resolved but the exchanges of information and negotiation itself, takes place directly between the parties.

How does it work?

Board Room Table working is a very flexible process and can be tailored to meet your circumstances and the level of support you require. You may progress one issue through the Board Room Table and use another process for a second or third issue.

Board Room Table discussions work best where there can be constructive discussion between the parties directly; a fairly level playing field both from an emotional and financial perspective and a good enough level of trust to be able to talk through the issues.  The parties need a clear understanding of what has to be discussed and recognition of the benefit in stopping the discussion if it becomes too tense or destructive.  Your “background” solicitor can help with directing the process as to what needs to be discussed to achieve solutions.

How long does it take?

This will depend on the circumstances, the pace you can each go and the issues to be resolved.

What happens with the outcomes reached?

If a satisfactory agreement is reached we will advise you on the outcome from a legal perspective and convert it in to a legal agreement for you to send to the other party for signature.  We can only act for one of you and will advise the other party to take their own legal advice on any documents we draft. 

What happens if it doesn’t work?

If a solution cannot be reached other methods of resolution remain available so the parties lose nothing by trying to resolve disputes in this way.  Even if full agreement has not been reached the areas of dispute may have been narrowed.  It is still an option to apply to the court or tribunal.

What happens if the other party does not have a solicitor?

There is no requirement that each party has solicitors but the outcome needs to be sensible for each of you and capable of being recorded in an appropriate document.
