What happens when it is your employees who are doing the monitoring?

With the advances in technology, particularly smartphones, covert recordings by employees are on the increase.  We have seen a rise in employees covertly recording disciplinary and grievance hearings, including even the private deliberations of the hearing panel.  What can you do if you discover an employee has been making covert recordings of their colleagues in the workplace?
